His criticism was directed at a recent Department of Justice filing which presented contrary evidence, suggesting that improper renovation work rather than malicious acts were responsible for the high-profile peeling paint issues that had captured public attention.

This latest development in the ongoing saga began on July 31, when federal prosecutors announced their intention to dismiss charges against David Hearn, a former Olympic athlete. Hearn had been taken into custody and formally charged in June with causing vandalism damage exceeding $1,000 to the iconic pool. The former Olympian maintained his innocence throughout the proceedings, asserting that he merely reached into the water to touch a section of paint that was already torn, and did not contribute to any additional harm.

According to the newly submitted court document, the root cause of the problem was a “botched installation” rather than deliberate vandalism. This revelation represented a significant pivot for officials within the Trump administration, who had consistently attributed the peeling paint to alleged acts of vandalism. President Trump had previously described extensive slashes measuring 300 yards in length that were allegedly made in the pool’s lining before it was forcefully pulled upward, characterizing the destruction as “purposefully and criminally done.” He further asserted that multiple individuals bore responsibility for damaging the distinctive “American flag blue” paint, a hue he proudly claimed to have selected.

On August 1, Trump voiced his strong disapproval of the DOJ’s decision to dismiss the case. He expressed complete disagreement, stating he disagreed “100%” with U.S. Attorney Jeanine Pirro, who authored the court filing recommending the charges be dropped against Hearn. While Trump maintained that the damage was inflicted by a knife or box cutter, he did concede that “there may have been some contractor difficulty” involved in the situation.

From Routine Maintenance to Political Storm

The Reflecting Pool, situated at the Lincoln Memorial in Washington, D.C., possesses a lengthy history of renovations and has unfortunately been prone to unsightly algae growth over the years. The current controversy originated from an ambitious initiative announced by President Trump aimed at revitalizing the landmark, which was originally constructed in the early 1920s. Two separate companies secured approximately $16 million in contracts to execute the renovation work, a figure that stood in stark contrast to Trump’s initial projection that the project would require only $1.5 million, as USA TODAY had previously documented.

On April 23, Trump unveiled his plans to transform the Reflecting Pool, noting that it had endured numerous complaints regarding leaks and insufficient cleanliness. Historical records and prior reporting indicate that algae has plagued the pool for decades. Trump declared that he had directed the bottom to be painted “American Flag Blue,” a rich navy shade. The National Park Service indicated that this particular color would enhance the pool’s reflective properties. The renovation scope encompassed draining, cleaning, and refinishing operations.

By May 7, while renovation activities continued, Trump made a visit to the construction site, driving his motorcade directly over the bottom of the emptied pool. The following week, on May 11, the Cultural Landscape Foundation initiated legal action against the Department of the Interior, alleging that the renovation project breached federal law by failing to conduct the appropriate review procedures required for modifications to historic sites.

The Reflecting Pool work concluded in early June, and the pool was subsequently refilled. However, algae quickly reappeared in the water, imparting a green tint to the Reflecting Pool. Workers responded by adding hydrogen peroxide to the water and implementing a nanobubble filtration system. Within a matter of weeks, visible damage to the pool’s liner became apparent.

Photographs taken on June 18 at the Reflecting Pool revealed sections of the blue layer tearing away and floating on the water’s surface. The following day, Hearn was apprehended at the pool site. He informed the Washington Post that he had reached into the Reflecting Pool and managed to “grab” an end of an already “flapping piece” of paint but did not cause any additional damage.

On July 2, Pirro held a press conference where she stated that witnesses observed a “violent effort” by Hearn to rip the sealant from the pool’s bottom, and she expressed confidence that she could demonstrate beyond a reasonable doubt that he was responsible for the damage.

The Reflecting Pool was cordoned off during Fourth of July festivities on July 4, and photographs taken days later showed the pool being drained once more. As of July 30, images confirmed that the pool remained empty.

Both Trump and Pirro remained steadfast in their assertion that vandalism caused the damage to the Reflecting Pool liner. Trump frequently shared his views on the alleged vandalism through social media platforms.

“It was purposefully and criminally done, and somebody had to work very hard, probably in the dark of night, to create such a condition,” Trump stated on June 23.

However, in her July 31 filing recommending the dismissal of Hearn’s charges, Pirro indicated that the damage “was the result of flawed installation by the contractor” and was exacerbated by the accelerated timeline to complete the project.
