Kroy “KJ” Jagger Biermann Jr. has been charged with aggravated sexual battery and aggravated sodomy following an alleged assault at a fitness facility in Fulton County, Georgia. The Alleged Incident

According to a criminal complaint filed on August 19, the events in question took place on the afternoon of April 23 inside the family changing area of a Life Time gym in Fulton County. The alleged victim, a minor, said she was eating at the gym’s café after completing a workout when she spotted Biermann and called out to him. At the time, Biermann was dating the girl’s best friend.

Per the complaint, Biermann invited her into the co-ed sauna, which is reachable through the family locker room. Once inside, the victim alleged that he grabbed her by the waist, kissed her neck, and grabbed her buttocks. She further claimed he touched her genitals over her clothing with enough force that it caused pain. The girl said she told him no “multiple times,” to which he allegedly responded with “something to the effect that she was lucky he wasn’t making her do it,” before pulling down his pants and orally sodomizing her. The report states he also digitally penetrated her and “tried multiple times to have sexual intercourse.”

The victim said she was eventually able to break free. The following day, after skipping school and experiencing a panic attack, she told her grandmother what had happened. Police were then called to a local hospital, where a sexual-assault examination was performed.

Charges, Arrest, and Custody

Biermann was taken into custody on August 17 and, as of the latest available information, remains held without bond. The two counts against him — aggravated sexual battery and aggravated sodomy — carry significant penalties under Georgia law, particularly when the victim is a minor. In Fulton County, cases involving juveniles accused of sex crimes often attract heightened public interest, and the decision to hold a teenager without bond underscores how seriously prosecutors viewed the complaint.

Defense Response

Attorney Jason Sheffield, representing Biermann, issued a statement on Friday, August 21, flatly denying the allegations. He emphasized the privacy owed to young people involved in such matters.

“First and foremost, this is not the kind of information that should be for public dissemination. These are juveniles. Secondly, my client is 100% innocent and tried to present evidence to the arresting officer,” Sheffield said, noting that his client submitted to a voluntary polygraph test and offered what he described as evidence of “prior false allegations by the alleged victim.”

Sheffield also pointed to the results of a sexual-assault kit, which he said showed no evidence of male DNA on or inside the alleged victim — a finding the report confirmed. He expressed the view that Biermann would not have been arrested had the arresting officer taken time to speak with him directly.

“Sadly, these false allegations are a desperate cry for attention and are motivated by my client’s past rejection of the alleged victim’s unwanted advances,” Sheffield continued. He called the arrest without bond “a tragedy” and reiterated that Biermann “is not only presumed innocent, but is in fact, innocent.”

Zolciak Breaks Silence

Kim Zolciak, who has kept a low profile since the charges became public, issued her own statement calling the allegations “nothing short of reckless and deeply troubling.” She spoke to the broader impact of unverified accusations, noting that “false accusations” can carry “devastating consequences” not only for the person accused but also “for genuine survivors of sexual assault and abuse.”

“Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence. At the same time, no one should be publicly condemned based solely on an accusation,” Zolciak said. “We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations.”

Biermann is the third child and eldest son of Zolciak and her ex-husband, former NFL player Kroy Biermann. The couple, who filed for divorce after roughly 11 years of marriage, share six children in total: KJ, now 15; Kash, 14; twins Kaia and Kane, 12; and Zolciak’s two daughters from a prior relationship, Brielle, 29, and Ariana, 24, whom Kroy Biermann legally adopted in 2013.
